Terms of Use – Le Bord

1. Introduction
Welcome to Le Bord (the "App"), provided by Herceta ("we", "us", "our"). These Terms of Use ("Terms") govern your access to and use of the App.
By creating an account, accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Eligibility and Account
- You must be at least the minimum age required by your local law to use the App, or use it with the permission and supervision of a parent, legal guardian, or school.
- You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
- You agree that the information you provide is accurate and kept up to date.
- Le Bord uses Google Sign-In and Sign in with Apple (via Firebase Authentication) to create and manage accounts.
3. Purpose of the App
Le Bord is designed to let students and teachers:
- Upload, organize and share exam documents (e.g., school tests, past papers).
- Enrich exam documents with metadata (subject, grade, school, location, year, sequence).
The App is intended for educational purposes only. It is not a platform to facilitate cheating in exams or violating school rules.
4. User Content
4.1 Definition
"User Content" means any content you upload or share via the App, including scanned documents, images, text, and metadata.
4.2 Your Responsibilities
You agree that:
- You own or have all necessary rights to upload and share the User Content.
- Your User Content does not infringe any copyright, trademark or other rights of third parties.
- Your User Content does not contain personal data of others without their permission, and in particular, you avoid uploading documents with unnecessary personal information (e.g., addresses, full grade sheets with names).
- Your User Content is not illegal, defamatory, harassing, hateful, or otherwise inappropriate.
- You are solely responsible for your User Content and for any consequences of sharing it.
4.3 License to Us
By uploading User Content, you grant us a non‑exclusive, worldwide, royalty‑free license to host, store, process, display and use that content as necessary to operate and improve the App (for example, to show documents to other users).
You can delete your User Content at any time within the App, subject to reasonable technical limits and backup retention.
5. Acceptable Use
You agree not to:
- Use Le Bord to cheat, share unreleased exam content, or violate academic or school policies.
- Upload content that is illegal, discriminatory, or harmful.
- Attempt to reverse engineer, hack, or interfere with the App's security or normal operation.
- Use the App to send spam or unauthorized commercial communications.
- Impersonate another person or misrepresent your affiliation.
We may investigate and, where appropriate, suspend or terminate accounts that breach these Terms.
6. Intellectual Property
- The App, including its design, logo, and underlying software, is owned by
- Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable license to use the App for your own non‑commercial, educational purposes.
- You may not copy, modify, distribute, sell, or lease any part of the App's code or design unless we give you written permission.
7. Third‑Party Services
Le Bord uses third‑party services such as:
- Google Firebase (for authentication, crash reporting and infrastructure)
- Google Sign-In
- Sign in with Apple
Your use of these services through the App is also subject to their respective terms and privacy policies.
8. Availability and Changes
- We strive to keep the App available but do not guarantee uninterrupted or error‑free operation.
- We may modify, suspend or discontinue the App or any feature at any time, with or without notice.
- We may update these Terms from time to time. If we make material changes, we will notify you within the App or by other appropriate means. Continued use of the App after changes take effect means you accept the updated Terms.
9. Disclaimer of Warranties
To the fullest extent permitted by law:
- The App is provided "as is" and "as available", without warranties of any kind, whether express or implied.
- We do not warrant that the App will be error‑free, secure, or free from viruses, or that it will meet your expectations.
- Exam content and other User Content are provided by users. We do not guarantee their accuracy, completeness, or suitability and are not responsible for any reliance you place on them.
10. Limitation of Liability
To the fullest extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or reputation, arising out of your use of or inability to use the App.
- Our total aggregate liability to you for any claim relating to the App will be limited to the greater of (a) the amount you paid to use the App in the last 12 months (if any) or (b) 50 EUR.
- Some jurisdictions do not allow limitations of liability; in that case, some of the above limitations may not apply to you.
11. Termination
You may stop using the App at any time and may delete your account if such feature is available.
We may suspend or terminate your access at any time, with or without notice, if:
- You breach these Terms;
- We are required by law;
- We decide to discontinue the App.
Upon termination, your right to use the App will cease. Certain provisions (for example, intellectual property, disclaimers, limitations of liability) will continue to apply.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of [COUNTRY / REGION], without regard to conflict of law rules.
Any dispute arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory law provides otherwise.
